Tenant Terms

Effective October 17, 2026

These terms cover tenants, applicants, co-signers and guarantors who use Sproutly, the website and apps at usesproutly.com, because a landlord uses it. Sproutly is operated by Natively, referred to here as we or us. By agreeing in the app, or by using the tenant portal, an application or a guarantor link, you agree to these terms. If you do not agree, do not use Sproutly, and ask your landlord for another way to apply, pay or reach them.

1. Sproutly is not your landlord

Your landlord uses Sproutly to run their rental. Sproutly is not your landlord, property manager or real estate agent, and it is not a party to your lease or your application. Your lease and your application are between you and your landlord.

Your landlord makes every decision about you: whether to approve or deny an application, the rent and fees, notices, repairs, deposits and anything else in your tenancy. Sproutly does not make those decisions and is not responsible for them. Questions or complaints about them go to your landlord.

2. Sproutly is not legal advice

Sproutly is software. It is not a law firm, and using it does not create an attorney-client relationship. Anything Sproutly shows about California or local law is general information. It can be wrong, incomplete or out of date. For advice about your situation, contact a California attorney, a local tenant rights organization or legal aid.

3. Applications and tenant screening

Credit and rental history reports come from the consumer reporting agency named on the screen, not from Sproutly. If you buy a screening report or an income verification, you pay Sproutly directly, and the receipt says so. To get a copy of a report or dispute what it says, contact that agency. If your landlord denies you based on a report, the law gives you the right to a notice that names the agency.

An application fee you paid through Sproutly is refunded to you on its own when no screening was run on your application: you withdrew, the screening could not be completed, or the home was rented to someone else first. In every other case the refund is a decision for your landlord, not for Sproutly.

Your Social Security number goes to the agency and is not stored by Sproutly. Give only true information, and only your own. Do not apply for, or sign in as, someone else.

4. Payments

Rent and other payments move through a third-party payment processor under its own terms. Sproutly is not a bank and does not hold your money; a payment goes to your landlord. Bank transfers can fail or be reversed after they appear to succeed. Keep your receipts, and check with your landlord if a payment does not show as received.

When you save a card for autopay, you authorize the processor to charge it on the schedule shown until you cancel.

5. Messages and notices

Your landlord may send you messages, documents and copies of notices through Sproutly. Your landlord is responsible for serving any legal notice the way the law requires. Keep your email address and phone number current so you receive what they send. Text messages are sent only if you turn them on, and you can turn them off at any time. If you sign a document electronically, consent is asked at signing, and you can request a paper copy from your landlord.

6. Your information

Your landlord controls the records about your tenancy and application in Sproutly. How we handle your information is in the Privacy Policy.

7. No warranty

To the extent the law allows, Sproutly is provided “as is” and “as available”, without warranties of any kind, including any warranty that it is accurate, complete, uninterrupted or fit for a particular purpose.

8. Limit of liability

To the extent the law allows, we are not liable for indirect, incidental, special or consequential losses, or for losses caused by your landlord’s decisions or actions. Our total liability for all claims about Sproutly together is limited to the greater of the amount you paid us directly in the 12 months before the claim arose and $100. Rent, deposits and fees you pay to your landlord are not payments to us. Nothing in these terms limits liability that the law does not allow us to limit.

9. False information

To the extent the law allows, you agree to cover our reasonable costs, including attorney fees, of claims that arise because you gave false information, used someone else’s identity, or broke these terms.

10. Your rights against your landlord stay the same

These terms are between you and us. They do not change your lease, and they do not give up or limit any right you have against your landlord under your lease or under California or local law.

11. Disputes: individual arbitration

Before either of us starts a claim, please send us a message and give us 30 days to try to resolve it.

To the extent the law allows, any dispute between you and us about Sproutly or these terms is decided by binding arbitration run by the American Arbitration Association under its consumer rules. The arbitration takes place in California, by video or in person as the rules allow. A court may decide whether this section applies, and the arbitrator applies California law.

Individual claims only. You and we each give up the right to bring or join a class, collective or representative action, and the right to a jury trial. The arbitrator may award relief only to the person who brought the claim.

Small claims. Either of us may instead bring an individual claim in small claims court.

You can opt out. Within 30 days after you first accept these terms, you can opt out of arbitration and the class and jury waivers by sending us a message that says you opt out. Opting out does not change anything else in these terms.

This section covers disputes with us only. It does not cover disputes with your landlord.

12. Time limit for claims

To the extent the law allows, any claim you have against us about Sproutly must be brought within one year after it arose. A claim brought later is barred.

13. Changes

We may update these terms. When we do, we change the effective date above, and for a change that matters we ask you to accept the new version in the app.

14. Governing law, severability and whole agreement

These terms are governed by California law. If a part of these terms cannot be enforced, that part is limited or removed to the extent needed, and the rest stays in force. These terms and the Privacy Policy are the entire agreement between you and us about Sproutly.

15. Contact

Questions about these terms: send us a message. Landlords using Sproutly agree to the separate Terms of Service.
